ABSTRACT

 

This research project intends to examine the roles of human rights organizations and conflict management in Nigeria. Using human rights and conflict resolution Center Abakaliki, Ebonyi state as a study. Human rights organizations and conflict management in Nigeria is the Back born and vital institution towards ensuring national peace for human co-existence and a catalyst to sustainable development. The methodology adopted was the questionnaire and interview, of the staff of human rights and conflict resolution center Abakaliki. The research also intends to save as a supporting guide to human rights and conflict resolution centres. The study also recommends necessary strategies towards greater human rights organizations and conflict management in Nigeria as regard growth and development of the counter

 

CHAPTER ONE  

INTRODUCTION

1.1      BACKGROUND OF THE STUDY

Human rights organizations and conflict management in Nigeria is an institution set to manage human rights violations it is however part of its Acts to ensure there is human co-peaceful existence of one another a society where everybody will be equal, a society where there will be no discrimination of whatsoever. Nwosu (2005: 7)

Moreover, conflict which is use to be a resultant effects of human rights violations became a major issues at the front burner of national discuss because of the destructions it has caused man and its environment, that has caused man to feel insecure in a society she co-owns in which, man is now a threat to fellow man as human rights violations continues. (Nwosu 2001:22).

However, even when the human rights Acts was well spelt, it was still been violated and hard to apply in our everyday living, even when Nigeria government recognized it in the constitution yet, this rights were not respected and it is stated as follows: 1999 constitution of the Federal Republic of Nigerian, chapter four of fundamental rights, section four, 33:1-46 Right to life:

v Right to dignity of human person

v Right to personal liberty

  • Right to fair hearing

v Right to private and family life

v Right to freedom of thought, conscience and religion.

  • Right to peacefully assembly and association
  • Right to freedom of expression and the press
  • Right to freedom of movement

v Right to acquire and own immovable property anywhere in Nigeria.

  • Compulsory acquisition of property
  • Restriction on and derogation from fundamental rights special jurisdiction of High-court and legal –aid.
  • Rights to freedom from discrimination

So, the in-cessant violations of human rights Act at every level gave rise to conflicts of various degrees and It is worrisome that human rights Acts violations could not be avoided because of human goals and aspiration always clash because of human beings underlying interest that is the agent of conflict of various degrees. It is unreasonable to hold the vision of a world without conflict. Conflict will always occur in any environment where these are more than one person or group interest Onwe (2004: 224). But, there is nothing wrong with conflict, it is a natural and inevitable human experience. And a critical mechanism by which goals and aspirations of individuals and groups are articulated. Conflict is also a “channel for definition of creative solutions to human problems and a means to the development of collective identify”.

As Ross (1993:xiv) noted:

If disadvantaged groups and individuals refuse to consider open conflict, they deny themselves what sometimes is most effective means for bringing about needed change.Similarly, conflict is not deviant, pathological or sick behaviour per se. It s not the opposite of order… there is orderliness in conflict, although conflict can become disorderly and it can be a very helpful and useful part of the society because disagreement does not mean break – up, but failing to reach consensus of which after wards they would come to term 1.e Agreement Idede (2004:10)

However, what to be feared is destructive conflict (that is conflict that have produce negative effects) rather than conflict itself. Thus, it is note worthy to explain the two type of conflicts that was mentioned in this research work, they are; creative or positive conflict and destructive conflict. Conflict is said to be positive when its constructively discussed by the parties and amicable terms for the settlement reached, then the situation becomes more interesting when the terms of settlement lead to mutual understanding and development. Idede (2004:90).

On the other hand, a destructive conflict is usually characterized by violence whether in its physical, psychological or structural connotation. The conflict manifests as dis-orderly show of power within this framework, a destructive conflict threatens rather than consolidates a governance process. A conflict is said to have become destructive when it exceeds the limits imposed by societal consensus also in a destructive conflict, process of conflict escalation is towards mutual attacks and efforts to destroy each other there are mis-judgements and mis-perceptions and situational entrapment in which the conflict become unduly magnified.

It is note worthy, that such a situation endanger decent human survival; most of the conflicts that have ravaged Nigeria of what it could have achieved so far, are as a result of definite exceeding societal consensus and cannot be said to be examples of productive conflict but destructive conflict , Idede (2004:52).

 

1.2   STATEMENT OF PROBLEMS

It is indisputable to assert that right from the beginning, the history of man on this planet earth has been characterized by continuous struggle for economic and political emancipation, struggle for equity equality and social justice, struggle against racial, gender bigotry, and against every form of inhumanity of man to man. Evidently human, beings desire freedom and liberty; but at the same time, they also want order and security. Consequently, the pages of many great history books unveil many remarkable records of squabbles that have emerged out of attempts of man to secure freedom, liberty, independency, social justice and peace in the midst of suppression and oppression. Men and women of valour tend to take a stand contrary to the thinking of their oppressors.
